Microsoft Will Lose The Google-Oracle Battle


A FUD machine seems to be coming in action the moment we heard Oracle filed lawsuit against Google over Android.

Some news media and analysts have gone out of their way in predicting that this move will scare OEMs and Microsoft will benefit from it.

"Android's success has been fueled by the large number of phone makers building smartphones based on it. Those phone makers, though, may be scared away by this suit. IDC analyst Al Hilwa told Computerworld"

How much of the Linux penetration was affected when Microsoft came out with 'baseless' accusations that Linux infringes on its patents (I did a long story back then for LINUX For You  magazine). Microsoft never showed the numbers. All they got was to 'force' some Linux companies to sign cross licensing deal with them and extort some money from Linux.
 
Did you see sales of Apple iPhones declining when telecom superpower Nokia and imaging superpower Kodak sued Apple over major  hardware patent infringements?
 
If Oracle's lawsuit is pointed Java implementation in Android, Nokia's lawsuit attacked the core hardware components of Apple iPhone. Nokia alleged that Apple's iPhone infringes Nokia patents for GSM, UMTS and wireless LAN (WLAN) standards.
 
"The ten patents in suit relate to technologies fundamental to making devices which are compatible with one or more of the GSM, UMTS (3G WCDMA) and wireless LAN standards. The patents cover wireless data, speech coding, security and encryption and are infringed by all Apple iPhone models shipped since the iPhone was introduced in 2007."

Do you see iPhone's existence if these technologies are to be removed? No.

The lawsuit was filed in January and there was no stopping iPhone 4. HTC was sued by Apple, did you see decline in HTC phones?  HTC counter sued Apple, any affect on iPhone sales?
 
Software patent related lawsuits and nothing more than an absurd circus that US government has necessarily created. We must scrap software patents as soon as possible.

There is no stopping of Android. Figures will tell soon. These OEMs are not basement based individuals which can be scared off by such lawsuits. There is no company without one or two lawsuits hanging with their necks owing to the flawed software patent law in the US.
 
Even if Oracle is technically right (which Google disagrees with), this move has damaged the Open Source community. Even if Oracle has emerged as a bad-boy for the Open Source community, Android will continue to thrive.

The FUD failed to work with Linux' patent infringement accusation. After Linux, Microsoft accused Android of infringing on their patents – it did not work either. I don't see this FUD to be working either.
