Apple now wants Judge Koh to issue a verdict announcing victory of Apple in this case and that all of Apple's patents are valid and Samsung infringed upon them. The reason for this 'request' is the rejected evidence (because the judge said it was submitted late) which Samsung released to some members of press on request.
The Verge reports, "Apple respectfully requests that the Court sanction Samsung by granting judgment in favor of Apple on its claim that Samsung infringes Apple’s phone design patents, and granting judgment that those patents are not invalid."
Apple's shenanigans don't end here. Apple further says in the filing that if court decides not to sanction samsung then the court should at a minimum...
(i) instruct the jury that Samsung engaged in serious misconduct and that, as a result, the Court has made a finding that Samsung copied the asserted designs and features from Apple products; and
(ii) preclude Samsung from further mentioning or proffering any evidence regarding the “Sony design exercise” for any purpose.
Why is Apple so afraid of the 'Sony design exercise' that it doesn't want Samsung to be allowed to mention it? At the same time it also wants the judge to instruct the jury that Smaung has copied the design? Then what's the point of having this trial?
This is getting crazier than we expected. This case is turning out to be a major PR disaster for Apple.
