Colin Birss (sitting as a Judge of the High Court, UK) said that Galaxy Tab does not infringe upon the design of Apple's iPad. The judge said that Galaxy Tab is not identical to the iPad even if there are some similarities but that doesn't account to design infringement. The judge actually criticized Samsung's design by stating that they "do not have the same understated and extreme simplicity which is possessed by the Apple design."

According to Bloomberg, Samsung released this statement, "should Apple continue to make excessive legal claims in other countries based on such generic designs, innovation in the industry could be harmed and consumer choice unduly limited."

This is an important victory for Samsung against Apple. Apple has been using stupid design patents to block competitors. A US judge last week banned the Samsung Galaxy Tab 10.1 citing design similarities. The US judge believed that the device was so similar that it could decieve a user.



I wonder if you will buy a device whose box clearly has in big bold letters Samsung Galaxy Tab 10.1, thinking that it was an iPad?
