Judge Richard Posner has dismissed the entire case of Apple v. Motorola in a ruling today. This is a bold and welcomed move to bring an end to the patent insanity spreading in the mobile industry. Apple has sued almost every Android player across the globe.
The judge also ensured that Apple won't refile the suit demanding injunction on Motorola by dismissing it with prejudice.
"It would be ridiculous to dismiss a suit for failure to prove damages and allow the plaintiff [Apple] to refile the suit so that he could have a second chance to prove damages. This case is therefore dismissed with prejudice," the judge wrote.
Motorola said in a statement, "We are pleased that Judge Posner formally dismissed the case against Motorola Mobility. Apple's litigation campaign began with their attempt to assert 15 patents against us. As it relates to Apple's violation of our patents, we will continue our efforts to defend our own innovation."
Apple recently refiled a case against HTC with ITC. The US needs patent reform, more than it needs SOPA/PIPA, and abolish software and process patents altogether to encourage innovation and progress in the mobile industry.
